However, there are specific legal requirements that RON providers in Florida Notaries should be aware of before conducting their first RON closings:

Training and Registration: Notaries in Florida must complete a two-hour course on RON, covering Florida’s specific regulations, and register as an online notary public with the state before performing any RON transactions.

Physical Presence: During RON transactions in Florida, the notary must be physically present within the state when performing the notarial act.

Remote Signer Flexibility: While the notary must be in Florida, the signer can complete the RON transaction from anywhere in the U.S., and under certain conditions, from anywhere in the world.

Identity Verification: Florida online notaries must confirm each signer’s identity through personal knowledge or by documenting the following:

  • A government-issued ID shared remotely via visual means.
  • Credential analysis of the ID by the notary.
  • Knowledge-based authentication (KBA) involves a minimum of five questions, with 80% accuracy required within two minutes.

Recording Requirements: The notary must create and retain an audio-video recording of the remote signing and notarial procedure for at least 10 years.

Electronic Journal: Florida law requires online notaries to maintain secure electronic journals of all remote notarizations performed.

RON in Florida enhances transparency in lending and offers greater flexibility for notaries, signers, and lenders. By utilizing secure remote options for real estate transactions, you can reduce reliance on paper, speed up the closing process, and minimize errors in documentation.
