Online Notarization in New York with Secured Signing

New York’s notary landscape is evolving rapidly with the introduction of a new law, NY Executive Law Section 135-c, which now authorizes notaries to perform electronic notarial acts. Beginning February 1, notaries can register with the Department of State to offer these services.

However, it’s important to note that, as of January 31, New York State will no longer permit remote ink notarization—a method that allowed notaries to perform their duties remotely during the pandemic by creating a paper record while communicating with signers via software.

In addition to these changes, the updated regulations require all notaries, including those providing traditional in-person services, to maintain a journal of all notarial acts performed.

This record must include the type of identification provided and be preserved for 10 years, ensuring a thorough and accountable process.
